OHANA PRICE MATCHING POLICY

1. INTRODUCTION

1.1 Ohana Communications Sdn. Bhd. (“Ohana”) is committed to providing the lowest price Business Fibre Broadband Package (“Ohana’s Broadband Package”) in Malaysia. This Price Matching Policy (“Policy”) sets out the price matching arrangements between Ohana and its existing customers (“Customer” or “you” or “your”) relating to the subscription for the Ohana’s Broadband Package.

1.2 This Policy forms part of the Ohana’s Customer Terms and Conditions and the Specific Terms and Conditions (if applicable), which should be read together with this Policy, a copy of which you may obtain at Ohana’s website on http://www.ohana.my/ or by phone request at Ohana’s customer service hotline at 1300-880- 880 or email at service@ohana.com.my.

1.3 This policy is effective until further notice by Ohana.

1.4 Ohana reserves the right, at its sole discretion, to terminate, withdraw, change or update the terms and conditions in this Policy from time to time. Ohana will notify you of any changes via announcement on the Ohana’s website or through other reasonable means of providing notice as Ohana may deem appropriate. Any changes to this Policy will be effective immediately upon notice to you. Your continued use and subscription for the Ohana’s Broadband Package after notice of any such change is given to you will be deemed as your consent and acceptance to be bound by the amended terms and conditions of this Policy.

2. PRICE MATCHING – The Rules

2.1 If you find a lower price for an identical competing business fibre broadband package (“Competing Broadband Package”) on comparable network contract terms currently available from another local Internet Service Provider in Malaysia (“Competing ISP”) and submit your written request for price matching to Ohana, Ohana shall, in its sole discretion, decide whether to match that lower price.

2.2 The Competing Broadband Package that is being considered for price matching must be identical with the ones offered by Ohana. The term “identical” refers to a product that offers the same fibre connectivity, business package, download speed, download quota, contract length, installation charges and other specifications as the Ohana’s Broadband Package that you have subscribed for.

2.3 The advertised price of the Competing Broadband Package must be valid at the time the price match is requested.

2.4 You will need to provide Ohana with the required supporting proof of the Competing Broadband Package such as an original or a photocopy of the advertisement or a hyperlink to the Competing ISP’s website where you found the lower price deal so that Ohana can verify the offer.

2.5 Ohana reserves the right to verify the Competing ISP’s advertised price, specifications and the availability of the Competing Broadband Package.

2.6 The price for comparison must include all associated costs, taxes and extras, and shall only be applicable to the subscription for the Competing Broadband Package made in Ringgit Malaysia.

2.7 The arrangements for price matching are as follows:

2.7.1 Within 30 days from the date of subscription:

a. if Ohana decides to match that lower price, the new price shall be reflected in your 2nd month’s bill (and the advance payments made by you will be pro-rated accordingly, where applicable) and shall be your new monthly service fee until the end of the Minimum Subscription Period (as defined in the Ohana’s Customer Terms and Conditions and the Specific Terms and Conditions); or

b. if Ohana agrees that the Competing Broadband Package is cheaper overall and decides not to match that lower price, you do not have to pay a cancellation fee and all advance payments (except the installation fee) shall be refunded to you.

2.7.2 After 30 days from the date of subscription:

a. if Ohana decides to match that lower price, the new price shall be reflected in your next monthly bill and shall be your new monthly service fee until the end of the Minimum Subscription Period (as defined in the Ohana’s Customer Terms and Conditions and the Specific Terms and Conditions);

b. if Ohana agrees that the Competing Broadband Package is cheaper overall and decides not to match that lower price, you have the sole discretion to decide whether to continue your subscription contract with Ohana. If you decide to terminate the subscription contract, you will be required to pay all accrued monthly service fees up to the last day of the billing month in which you decide to terminate the subscription contract as well as the Cancellation Fee; or

c. if Ohana decides to match that lower price and offer you a new price, but you still decide to terminate the subscription contract, you shall be required to pay a sum equivalent to the remaining monthly service fee of the remainder of the Minimum Subscription Period (as defined in the Ohana’s Customer Terms and Conditions and the Specific Terms and Conditions) as well as the Cancellation Fee.

2.8 Any decision of Ohana on all matters relating to or in connection with this Policy shall be final and binding on you. Ohana shall not be obliged to enter into or entertain any correspondence or complaint on any matter concerning this Policy.

3. PRICE MATCHING – The Exclusions

3.1 This Policy does not apply to the following:

a. the Competing Broadband Package advertised or sold at special sale events e.g. grand opening, anniversary, sales, promotions;

b. the Competing Broadband Package advertised or sold with special coupons, vouchers, cash back, discounts, or other enticement offers that may be available from time to time;

c. prices or discounts of the Competing Broadband Package that are associated with club, loyalty or points collection cards or credit or debit cards from certain banks or financial institutions;

d. advertisements where the sale prices cannot be determined from the advertisements;

e. expired advertisements;

f. advertisements with misprinted prices or typographical pricing errors;

g. the Competing Broadband Package advertised or sold as limited in quantity, time or supply;

h. the Competing Broadband Package advertised or sold as special offers, online-only offers, bundled offers, financing offers, clearance offers, rebates, coupons;

i. the Competing Broadband Package is not available for sale, installation, subscription or use in Malaysia;

j. the Competing Broadband Package comes with a free gift with the subscription;

k. the Competing Broadband Package requires a separate or combined purchase to get the advertised price;

l. rebates or discounts on the Competing Broadband Package personally offered by individual resellers; or

m. any combination of the foregoing.

4.2 Please provide the required supporting proof of the Competing Broadband Package (if that is still in effect) that you would like Ohana to price match.

4.3 Ohana will then review and verify the price match request and will respond to your price match request within 30 days from the date of your request.
